Abstract

The criminal organizations, they have become, today, in the phenomenon that more questions to current societies, as the disciplines of law and its legal doctrine-and criminal. While it is true that begin as common criminal groups, they end up being a parallel society that seeks to operate within and outside the State, involving complex structures, self-regulating normatively, disciplined, and many times spreading the political class.

 

In this sense, organized crime is one of the most serious problems facing the globalized world, in attention to their transnational crimes of all kinds, the territorial dominion, economic, military, and up to technological development; which makes them a threat to the stability of nations, its international relations and human rights.

 

The features that surround and identify the criminal organizations, as well as those that differentiate them, hinder criminal investigations, processing and dismantling given the ease, they have to penetrate the physical boundaries, in the network, and to immersion in legal activities or with the appearance of legality; always in attention to their needs for expansion and control, characteristics which belong to them.

 

Based on the above, it can be said that organized crime structures permeate all social spheres, covering politicians and businessmen with their mantle of corruption, destabilizing nations from the center of their institutionality, making the soul of the State a parastate, incapacitated for its legal-penal, disciplinary and administrative control, under penalty of having to condemn oneself, allowing a door to the reflections of political, economic and ethical convenience; for the sake of making shameful and serious recognitions that destabilize international relations and institutional relations of the State.

 

It is facing a deadly epidemic and global, which obliges us to know its elements, features, genesis, development and mutations. Requires structuring strategies and international figures of a legal-political, among others; to prevent them from growing, evolving and planning new strategies of cooperation, alliances, reorganization and merger between them; making it impossible for the exercise of control of criminal prosecution for its dismantling.
